We would like to let you know that the The Ombudswoman for foreign workers' labor rights in the Ministry of Labor and Welfare, who is obligated to promote the keeping of labor rights of migrant workers, has published her stance on the issue of payment on Weekly day off (and holidays – as it derives from the same law).
Her stance is similar to Kav Laoved’s stance and is based on Decision of the Labor High Court, that a payment of weekly day of or holiday is 361.68 NIS. This should not be mistaken for payment of vacation (annual leave) which is 212 NIS.
Her stance in Hebrew is attached, and this is the translation:
The monthly salary and wages for employing foreign workers correlates to the minimum wage set in the Israeli labor market, which is currently 5300 NIS (before deductions).
Regarding the payment for the weekly rest day -
The value of the "regular" work day of the employee (the monthly salary divided by 25 days) is NIS 212 per day. An employee who is required to work on their day of rest is entitled to an additional 150% of their salary.
i.e, the value of a caregiver work day on a rest day is worth 318 ₪.
Since the length of the rest day for a foreign caregiver is 25 hours, the above amount must be added for an additional hour (25th hour) (as stipulated in the labor court decision in the case of 1874-03-16 Steinberg v. Todika) for a total of 43.68 ₪.
In conclusion – the total payment for the weekly rest day when a foreign caregiver worked on his rest day is NIS 361.68.
