INFORMATION ABOUT NEW LAW REGARDING SPECIAL VISA APPLICATIONS

INFORMATION ABOUT NEW LAW REGARDING SPECIAL VISA APPLICATIONS

We've received a lot of inquiries regarding special visa applications and eligibility.

Here's a complete guide courtesy of Kav Laoved - Migrant Caregivers Facebook Page. Please read accordingly and share to your friends.

---------------------------------------------

We would like to clarify the new law/regulations regarding caregivers without a valid working visa – in light of the massive disinformation about this on Facebook and other platforms. Please read the information below and share it with your friends.

We are providing below GENERAL INFORMATION ONLY. Please check with your agencies for more details about your specific situation. The new options for Special visas are limited for certain groups of caregivers, as detailed below.

FIRST OF ALL – These 3 regulations apply to you only IF YOU ARE LESS THAN 13 YEARS IN ISRAEL.

Regulation 1:

IF:
a Special ("humanitarian") Visa had been submitted for you and rejected (no matter for what reason) after March 1, 2020 and before March 31, 2021

AND
you are still working with the same employer

THEN
a Special Visa application can be re-submitted now (for the same employer).
It should be re-submitted by the agency, and be sent before October 21, 2021.

---------------------

Regulation 2:

IF
An appeal to the court was submitted for you about special visa even before covid and until March 31, 2021

AND
you are still working with the same employer

THEN
You MAY be eligible for re-submission of Special Visa application (for the same employer). PLEASE CONSULT THE LAWYER / AGENCY. This should be re-submitted by the agency, and be sent before October 21, 2021

-------------

Regulation 3:

IF
you are in Israel 51-63 months,

AND
was registered in the agency with the employer between March 1, 2020 - March 31, 2021 for TEMPORARY regular visa even though you were between 51-63 months (without Special Visa application)

AND
you are still working with the same employer

THEN
The family can now submit through the agency an application for the caregiver's special visa application (for the same employer) even if you are not yet 63 months in Israel. THE AGENCY must send the application directly to MISRAD HAPNIM (PIBA, the Ministry of Interior) BY October 21, 2021.

----------------------

DEPOSIT ISSUES FOLLOWING WHAT IS WRITTEN ABOVE:

1. If one of the situations above applies to you and you resubmit the application – your deposit should be safe until further notice.

2. If a special visa application was submitted for you after March 31, 2021, and the Special Visa was rejected, and/or you were asked to leave by June 30, 2021, then you can continue working for the same employer, and finish by October 31, 2021. Your deposit should be safe without deductions by November 30, 2021.

IMPORTANT:

All other caregivers, which don't fall into the above categories, e.g. if you worked without registration and/or no special visa application was submitted for you, etc. – then there is still no Law or regulation that makes it safe for you to stay in Israel. If you are found by immigration, they may deport you. Regarding the deposit money - deductions WILL BE performed, calculated from the date of May 1, 2021.
