Migrant Caregivers in Israel: 5,300 NIS Minimum Wage, How Come You're Getting Paid Less?

Everyone who is working in Israel legally as a Migrant Caregiver signed a one year renewable contract with an employer for a Live-In or Live-out caregiving job. This contract is composed of bulleted information, job description and includes the amount of salary, weekly allowances, holiday compensation, recuperation pay and pension which the caregiver is entitled to receive for the whole employment period until the contract will be terminated for whatever possible reasons.

 

5,300 NIS is the minimum wage a migrant caregiver must receive every month. But why are they getting paid less than this amount? 

 

The Commission of Foreign Workers Labor Rights published this memo yesterday, December 6, 2020 on their official Facebook Page in order for Caregivers to understand why the law requires a series of deductions from the 5,300 NIS minimum wage.

Many ask us - If the minimum wage is 5,300 NIS, how come I'm getting paid less as a Caregiver!?
We are here to explain!
 
The minimum wage in the State of Israel is 5,300 NIS and this is the minimum wage that determines when there is no industry minimum such as in the nursing industry.
 
In addition, there are two important things you must know:
 
1. The "pocket money" most of you get every week (which is not mandatory) is usually part of your salary that is paid in advance, unless the parties agreed otherwise.
 
2. Your employer is allowed to deduct out of your monthly salary:
# Amounts for participation in medical insurance - As of January 2020, the maximum amount that can be deducted from the worker's salary is 143.97 NIS per month.
 
# Expenses for housing - which depends on the area of residence and the patient's ownership on the house, and related expenses (80.47 NIS).
 
# Food expenses - The employee can give his written consent in a language he understands, that from his salary expenses for food purchased for him as part of his work for the employer, he will be deducted depending on the market value of the food purchased for him, when the maximum deduction will not exceed 10% of the minimum wage, meaning 530 NIS.
 
In the attached example you can see what the monthly salary of a caregiver who works in the Jerusalem area at a home owned by the patient. Also attached is a table of allowable deductions for living expenses by area.
 
Please note that the minimum wage is the determining wage for the purpose of calculating the employee's social rights. Meaning, the percentage of benefits you get at the end of the working relationship should be calculated out of the minimum wage (without deductions).

שכר המינימום במדינת ישראל עומד על 5,300 ₪ וזהו שכר המינימום הקובע כאשר אין מינימום ענפי כמו בענף הסיעוד.
בנוסף לכך, ישנם שני דברים חשובים שאתם חייבים לדעת:
1. "דמי הכיס" הם בדרך כלל חלק מהשכר החודשי של העובד המשולם כמקדמה, אלא אם הצדדים סיכמו אחרת.
2. מתוך שכר מינימום זה המעסיק יכול לנכות סכומים בגין:
# השתתפות בביטוח רפואי - החל מינואר 2020 הסכום המקסימלי שניתן לנכות משכר העובד הוא 143.97 ₪ לחודש.
# הוצאות בגין מגורים - אשר משתנות בהתאם לאזור המגורים ולבעלות המטופל על בית המגורים, והוצאות נלוות (80.47 ₪).
# הוצאות בגין כלכלה - העובד יכול לתת הסכמתו בכתב, בשפה שהוא מבין, כי ינוכה לו מהשכר הוצאות עבור מזון שנקנה עבורו במסגרת עבודתו אצל המעסיק וזאת בהתאם לשווי השוק של המזון שנקנה, כאשר המקסימום שניתן לנכות אינו יכול לעלות על 10% משכר המינימום, כלומר 530 ש"ח.
בדוגמא המצורפת אתם יכולים לראות כיצד אמור להראות השכר החודשי של מטפל אשר עובד באזור ירושלים בבית אשר בבעלות המטופל. כמו כן, מצורפת טבלה של ניכויים מותרים בגין הוצאות מגורים לפי אזור.
שימו לב, כי שכר המינימום הוא השכר הקובע לצורך חישוב הזכויות הסוציאליות של העובד/ת. כלומר, האחוז אותו מפרישים משכר העובד בעת סיום העסקתו, הוא משכר המינימום הקבוע בחוק (ללא ניכויים).
