Are You Entitled to Have National Insurance even Without Visa?

When you're without Visa, you won't be able to enjoy the normal benefits of a legal Caregiver in Israel. This includes all the monetary benefits that a Caregiver usually is entitled to after a year of work with one employer. However, according to The Commissioner of Foreign Worker's Labor Rights in Israel, a Caregiver, regardless of whether he or she has a Visa or Not is entitled to a Bituah Leumi.
Visa or no visa, you are eligible for National Insurance (Bituah Leumi)!
A foreign worker is insured with the National Insurance Institute for three types of insurance:
1. Work injury:
The purpose of work injury insurance is to compensate insured workers for the loss of income they will suffer after an injury, during the period they are unable to work. Therefore, the National Insurance Institute pays workers an injury allowance for a period of up to three months.
According to the medical board, if the injured worker remains disabled as a result of the injury, he is entitled to a work disability pension or grant.
Injured workers are also entitled to free medical treatment for their injuries.
2. Bankruptcy and corporate liquidation:
In the event the employee is served with a bankruptcy, liquidation, or execution order, the worker is entitled to benefits. The benefit includes payment of wage debt, severance pay, and payment of the debt owed to the worker's provident fund for arrears accumulated by his employer.
3. Maternity:
Foreign workers or the spouses of foreign workers employed in Israel may be able to claim the following benefits, regardless of whether they are self-employed:
- Hospitalization grant (paid to the hospital to which the mother was admitted, to cover hospitalization costs).
- Birth grant (paid directly into the mother's bank account)
- Childbirth allowance (paid to a mother who gave birth to three or more children in a single delivery)
Insurance conditions are similar to those applying to an Israeli worker, besides the two conditions below that apply to a foreign worker:
1. The birth took place in Israel.
2. The mother (or her spouse) has at least 6 consecutive months of employment in Israel.
It is important to note that a worker without National Insurance covered by his employer will not be entitled to the above benefits.
ויזה או ללא ויזה, המעסיק שלכם חייב בתשלום דמי ביטוח לאומי.
עובדים זרים מבוטחים בביטוח הלאומי בעבור עובד ל-3 ענפי ביטוח:
1. ביטוח נפגעי עבודה:
ביטוח נפגעי עבודה נועד לסייע למבוטחים שנפגעו בעבודה ולפצות אותם על אובדן הכנסתם בתקופה שלאחר הפגיעה, שבה נעשו בלתי כשירים לעבוד. לשם כך משלם להם הביטוח הלאומי דמי פגיעה לתקופה של עד 3 חודשים.
אם נותרה לנפגע נכות כתוצאה מהפגיעה, העובד יהיה זכאי לקצבת נכות מעבודה או למענק, בהתאם להחלטת הוועדה הרפואית. בנוסף, העובד יהיה זכאי לקבל טיפול רפואי חינם בשל תוצאות הפגיעה.
2. ביטוח זכויות עובדים בפשיטת רגל ובפרוק תאגיד.
עובד שכיר שנגד מעסיקו ניתן צו פשיטת רגל, צו פירוק או צו לפתיחת הליכים זכאי לגמלה. הגמלה כוללת תשלום חוב שכר עבודה ופיצויי פיטורים, וכן תשלום חוב לקופת הגמל של העובד עבור הכספים שהיה מחויב המעסיק להפקיד לקופת הגמל.
3. ביטוח אימהות:
עובדת זרה או אשת עובד זר המועסק בישראל, עשויה להיות זכאית לתשלומים הבאים, גם אם אינה מועסקת בעצמה:
- מענק אשפוז (משולם לבית החולים שבו אושפזה היולדת, לכיסוי הוצאות האשפוז).
- מענק לידה (משולם ישירות לחשבון הבנק של היולדת)
- קצבת לידה (משולמת למי שילדה שלושה ילדים ויותר בלידה אחת).
תנאי הביטוח דומים לאלו של תושבי ישראל, למעט שני התנאים הבאים החלים על העובדת הזרה:
1. הלידה ארעה בישראל
2. ליולדת (או לבן זוגה) יש לפחות 6 חודשי העסקה רצופים בישראל.
שימו לב – עובד שהמעסיק שלו אינו משלם עבורו לביטוח הלאומי אינו זכאי לאמור לעיל.
